Terms of Service
These terms govern your use of Klk IA. By using the service you accept them. See also our Privacy Policy. A Spanish version is available on request; the English text prevails.
1. Who we are
Klk IA is operated by Max Francisco Medina Estrella (trading as Medina Labs), Hamburg, Germany. Contact: max@medina-labs.com. Full details are in the Impressum.
2. The service
Klk IA connects your WhatsApp Business number, reads your incoming messages and sends you a periodic summary of what needs your attention. The only messages you get from the system are that digest, a short nudge when it is ready, and replies to the commands you send it. It does not reply to your contacts, negotiate, close sales or act on your behalf beyond that.
Klk IA is offered to businesses and professionals, not consumers. Klk IA is not affiliated with or endorsed by Meta or WhatsApp. By connecting your number you opt in to receive the digest and nudges on WhatsApp. To stop them, cancel your subscription or email us.
3. Acceptable use
You agree to:
- Connect only WhatsApp numbers you legitimately control.
- Comply with the WhatsApp and Meta policies that apply to your business account.
- Not use the service to surveil people or to process conversations unrelated to your professional activity.
- Not resell or redistribute the service, or connect your own programs or bots to your account, without prior agreement.
- Not interfere with the service's infrastructure or access other users' data.
We may suspend an account that breaches these points, and will notify you where reasonably possible.
4. The digest is an aid, not a guarantee
The digest is generated by an AI model and can get things wrong, such as misjudging urgency or misreading a message. It helps you prioritize; it does not replace reading your conversations. You remain responsible for what you answer, fulfill or miss with your clients.
5. Payment, trial and cancellation
Klk IA is a monthly subscription at the price shown when you subscribe. The first time you subscribe you get a 30-day free trial: you add a card to start it and nothing is charged during the trial. Unless you cancel before it ends, the first charge happens when the trial ends, and the subscription then renews automatically every month. Payments are processed by Stripe.
You can cancel at any time with the "Manage billing" button in your dashboard. Cancellation takes effect at the end of the period you already paid for; until then you keep your digest and are not charged again. If you cancel during the trial, you are not charged at all.
If a charge fails, Stripe retries it over a few days and emails you, and you keep your digest meanwhile. If every retry fails, the subscription is canceled and the digest stops. You can subscribe again from your dashboard, without a new free trial.
If the price changes, we will tell you in advance and the new price applies from the next billing period. Fees already paid are non-refundable, except where the law requires otherwise. Prices do not include taxes unless stated, and any taxes, bank fees or withholdings that apply in your country are your responsibility.
6. Data and privacy
For your contacts' messages we act as your processor, as explained in the Privacy Policy. We commit to:
- Process them only to generate your digest and answer your commands, on your instructions (using the service is that instruction), and never for our own purposes.
- Ensure anyone with access is bound by confidentiality, and apply the security measures described in the Privacy Policy.
- Use only the providers listed in the Privacy Policy, which you authorize by accepting these terms. We will tell you before adding or replacing one, by updating that list and notifying you; if you disagree, you can cancel.
- Help you answer your contacts' requests about their data, such as access or deletion.
- Notify you without undue delay of any security breach affecting that data.
- Delete the data when the service ends. It is also deleted automatically after 7 days, as the Privacy Policy explains.
7. Availability
The service is provided as is, with no uptime commitment. It depends on third parties (Meta, OpenAI, our hosting providers) and may be interrupted by maintenance, outages or changes to their terms. We do not guarantee that any given digest will be generated or delivered at a particular time.
8. Limitation of liability
To the extent permitted by law, we are not liable for lost profits, lost clients, or indirect or consequential damages arising from use of the service, including a message the digest failed to surface. Our total liability to you is limited to the amount you paid in the three months before the event giving rise to the claim. Nothing in these terms limits liability for intent, gross negligence, injury to life, body or health, or any liability that cannot be excluded by law.
9. Changes to these terms
If these terms change materially, we will let you know over WhatsApp and update the effective date above. Continuing to use the service after that notice means you accept the new version.
10. Governing law
These terms are governed by the laws of Germany. Any dispute will be submitted to the competent German courts.
